{"id":265,"date":"2024-01-06T00:17:50","date_gmt":"2024-01-06T00:17:50","guid":{"rendered":"https:\/\/abogadovenezuela.com\/blog\/?p=265"},"modified":"2024-01-06T03:17:47","modified_gmt":"2024-01-06T03:17:47","slug":"certificacion-de-gravamenes","status":"publish","type":"post","link":"https:\/\/abogadovenezuela.com\/blog\/2024\/01\/06\/certificacion-de-gravamenes\/","title":{"rendered":"CERTIFICACI\u00d3N DE GRAV\u00c1MENES"},"content":{"rendered":"\n<p>&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>El tema de hoy surge, por un cliente que nos busca para el asesoramiento legal-inmobiliario en la venta de un pent-house de su propiedad situado en la Urbanizaci\u00f3n Terrazas del \u00c1vila, Municipio Sucre de Caracas, y el abogado de la compradora le exige una certificaci\u00f3n de grav\u00e1menes con menos de treinta (30) d\u00edas de expedida por  el Servicio Aut\u00f3nomo de Registros y Notar\u00edas (SAREN).<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Amigos y amigas, la certificaci\u00f3n de grav\u00e1menes es una constancia en que se expresa si sobre el inmueble pesan grav\u00e1menes, medidas judiciales o cargas del alg\u00fan tipo, y en caso afirmativo, contiene la correspondiente referencia a los datos de dichas medidas o grav\u00e1menes; expresando tambi\u00e9n un resumen de la tradici\u00f3n y se\u00f1alamiento del propietario actual.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00bfC\u00f3mo se obtiene?<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; El tr\u00e1mite no es muy complicado, debes acceder a la p\u00e1gina web del Servicio Aut\u00f3nomo de registros y Notar\u00edas (SAREN), para que en el rengl\u00f3n de tr\u00e1mites obtengas toda la informaci\u00f3n necesaria:<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Debes tener listos los recaudos siguientes:<\/p>\n\n\n\n<p>1.- C\u00e9dula de identidad<\/p>\n\n\n\n<p>2.- Documento de propiedad<\/p>\n\n\n\n<p>3.- El formulario de solicitud debidamente lleno<\/p>\n\n\n\n<p>4.- Ficha catastral<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00bfD\u00f3nde se solicita?<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Una vez que tengas toda la documentaci\u00f3n en original y fotocopia debes dirigirte a la Oficina de Registro Inmobiliario respectiva, esperar tu turno y presentar los recaudos ante el funcionario registral y pago del impuesto correspondiente. Consignados los recaudos, te indicar\u00e1n d\u00eda y hora para el retiro de la Certificaci\u00f3n.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; En la planilla de solicitud colocar\u00e1s datos de identificaci\u00f3n del solicitante, del propietario y datos de registro del documento de propiedad.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; En el caso que nos lleg\u00f3 al escritorio, el inter\u00e9s de la compradora, trasmitido a trav\u00e9s de su representante legal, era que la certificaci\u00f3n de grav\u00e1menes evidenciara, que sobre el inmueble objeto de la negociaci\u00f3n, no exist\u00edan hipotecas, medidas de embargo ejecutivo o prohibiciones de enajenar y gravar u otras cargas; y tambi\u00e9n constatar la titularidad registral de nuestro cliente.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Es importante se\u00f1alar, que cuando se vaya a adquirir un inmueble, contar con el asesoramiento de un abogado de confianza.
